Terms of service
These Terms of Service (hereinafter referred to as “the Terms”) set forth the conditions for using the online shop (hereinafter referred to as “the Service”) provided by BELVET (hereinafter referred to as “we,” “us,” or “our”) on this website. All registered users (hereinafter referred to as “Users”) are required to use the Service in accordance with the Terms.
Article 1 (Application)

The Terms apply to all relationships between Users and us in connection with the use of the Service.

In addition to the Terms, we may establish rules and other provisions regarding the use of the Service (hereinafter referred to as “Individual Rules”). Regardless of their name, these Individual Rules shall form part of the Terms.

If the provisions of the Terms conflict with those of the Individual Rules, the Individual Rules shall prevail, unless otherwise specifically provided.
Article 2 (User Registration)

In the Service, registration is completed when an applicant agrees to the Terms, applies for registration in the manner prescribed by us, and we notify the applicant of our approval.

We may refuse registration if we determine that an applicant falls under any of the following, and we have no obligation to disclose the reasons:

If false information was submitted at registration

If the applicant has previously violated the Terms

If we otherwise deem the registration inappropriate

Article 3 (User ID and Password Management)

Users shall manage their User ID and password at their own responsibility.

Users shall not transfer, lend, or share their User ID or password with any third party under any circumstances.

If a login is made with a combination of User ID and password matching the registered information, we will regard it as use by the registered User.

We are not responsible for any damages caused by third-party use of a User’s ID or password, except in cases of our willful misconduct or gross negligence.
Article 4 (Sales Contract)

A sales contract is established when a User applies to purchase a product and we notify the User of our acceptance. Ownership of the product transfers to the User at the time we hand the product over to the delivery company.

If the User is a minor, they must obtain the consent of a parent or guardian before purchasing. If a purchase is made by a minor, it shall be deemed that such consent was obtained.

We may cancel a sales contract without prior notice if the User:

Violates the Terms

Cannot be reached due to unknown address or long absence

Otherwise damages the relationship of trust between us and the User

Payment methods, delivery methods, cancellation procedures, and return methods shall be determined separately by us.
Article 5 (Intellectual Property Rights)
All copyrights and other intellectual property rights in product photos and other content provided through the Service (hereinafter referred to as “Content”) belong to us or legitimate rights holders. Users may not reproduce, reprint, modify, or otherwise make secondary use of the Content without authorization.
Article 6 (Prohibited Actions)
Users must not engage in any of the following:

Acts that violate laws or public order and morals

Acts related to criminal conduct

Infringement of copyrights, trademarks, or other intellectual property rights

Destroying or interfering with our server or network functions

Commercial use of information obtained through the Service

Acts that may disrupt the operation of the Service

Unauthorized access or attempts thereof

Collecting or storing personal information of other Users

Impersonating other Users

Providing benefits to antisocial forces in connection with the Service

Other acts deemed inappropriate by us
Article 7 (Suspension of Service)
We may suspend or interrupt all or part of the Service without prior notice if we determine any of the following:

Maintenance or updates of the system related to the Service

Provision of the Service is difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters

Computers or communication lines stop due to accidents

We otherwise determine that providing the Service is difficult
We bear no responsibility for any disadvantage or damage incurred by Users or third parties due to suspension or interruption of the Service.
Article 8 (Usage Restrictions and Deregistration)
We may restrict all or part of a User’s use of the Service or cancel their registration without prior notice if the User:

Registers with false information

Has their registered credit card suspended

Fails to fulfill payment obligations

Does not respond to our communications for a certain period

Has not used the Service for a certain period

Is otherwise deemed inappropriate for the Service
We bear no responsibility for any damages caused to the User by actions taken under this Article.
Article 9 (Withdrawal)
Users may withdraw from the Service through the prescribed withdrawal procedure.
Article 10 (Disclaimer and Limitation of Liability)

We do not guarantee that the Service is free of factual or legal defects (including safety, reliability, accuracy, completeness, validity, suitability for a specific purpose, security, errors, bugs, or infringement of rights).

We are not responsible for any damages arising from the use of the Service. However, if the contract between the User and us (including the Terms) constitutes a consumer contract under the Consumer Contract Act of Japan, this disclaimer shall not apply. Even in such cases, we shall not be liable for damages caused by special circumstances (foreseeable or otherwise) due to our negligence (excluding gross negligence).

We are not responsible for any transactions, communications, or disputes arising between Users and other Users or third parties in relation to the Service.
Article 11 (Changes to the Service)
We may change the content of the Service or discontinue the Service without notice to Users, and shall not be liable for any damages caused to Users as a result.
Article 12 (Amendment of the Terms)
We may amend the Terms at any time without notice if deemed necessary. If a User starts using the Service after the amendment, the User shall be deemed to have agreed to the amended Terms.
Article 13 (Handling of Personal Information)
Personal information obtained through the use of the Service shall be handled appropriately in accordance with our Privacy Policy.
Article 14 (Notices and Communications)
Notices or communications between Users and us shall be made in the manner prescribed by us. Unless Users notify us of changes in accordance with our prescribed method, we will assume the currently registered contact information is valid and consider communications sent to it as having reached the User at the time of dispatch.
Article 15 (Prohibition of Assignment of Rights and Obligations)
Users may not transfer or pledge their position under the usage contract or rights or obligations under the Terms to a third party without our prior written consent.
Article 16 (Governing Law and Jurisdiction)
The interpretation of the Terms shall be governed by Japanese law, with the United Nations Convention on Contracts for the International Sale of Goods excluded. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over our principal office location.
